Car Accidents

Massachusetts No-Fault Insurance and Serious Injuries

Massachusetts is a no-fault auto insurance state. However, if you suffer a serious injury in a car accident, your no-fault coverage will not go far in covering damages such as hospitalization, surgery, physical therapy, lost wages, and pain and suffering. For serious injuries, you have the right to seek full compensation from the insurance company of the person who caused the accident.

As a personal injury lawyer with more than three decades of experience in Boston and other communities in Massachusetts, I have extensive experience in dealing with insurance companies to help my clients recover the full compensation they deserve.

Massachusetts No-Fault and the Tort Threshold

Massachusetts no-fault auto insurance coverage provides personal injury protection (PIP) to cover damages such as lost wages and medical bills after a car crash, regardless of fault. However, your PIP coverage is limited to a few thousand dollars and does not even cover things like pain and suffering.

To file a personal injury claim beyond the no-fault limits, your car accident injury must meet what is known as the “tort threshold.” Examples of tort threshold injuries include:

  • Broken bones
  • An injury that causes permanent damage to a body part
  • A disfiguring scar
  • Brain injury
  • Paralysis

As your lawyer, I can evaluate your case and ensure that you do everything you can do to obtain the proper documentation of the seriousness of your injury from your treating physician. If your injury meets the tort threshold, I will negotiate on your behalf with the insurance company of the at-fault driver. And rest assured, I won’t hesitate to present your case to a jury if it’s the best way to recover maximum damages.

I handle all car accident cases on a contingency fee basis, which means there are no attorney fees unless I make a recovery for you.
